What are Deed Restrictions?

The Declaration of Covenants, Conditions and Restrictions (known as the DCCR’s or Covenants, but most commonly called the Deed Restrictions) for Crighton Ridge also include specifications related to construction and maintenance of existing property. These specifications are primarily intended to assure maintenance of community standards and thereby property values.

The deed restrictions are enforced through a regular monthly inspection by the management company. Letters are sent to owners where an issue is identified. If the issue is not rectified by the owner the association has the legal right to seek compliance through the Civil Court system. All costs related to legal enforcement are to be paid by the property owner.

Some of the more common deed restriction violations include:

  • Boat, trailer, RV, Camper, etc. stored in front of the home, on the driveway or in sight on property (Note that storage behind a wrought iron fence is not out of sight)
  • Storage of construction or gardening materials on the drive except for a short time when the project is underway
  • Upkeep of visible property (including such things as mowing of lawn, mildew or stains on home, dead trees, accumulation of trash or unsightly articles, etc.)
  • Commercial signs (except for realtor signs that comply with deed restrictions)
  • Cars or other vehicles parked on lawns, stored on the drive or parked habitually in view
  • Modifications or improvements which have not been approved by the ARC
  • Pool equipment that is not screened from public view, as required in the deed restrictions
  • Trash cans in front of house or in sight on property (except on garbage pick-up days)

Deed Restrictions – This is the original 27 page document. At the time that it was written, only Section 1 was in existence. Most, but not all, of the information used to determine deed restriction violations is located in Articles IV – V.

Amended Deed Restrictions – This 4 page document that lists the amendments that apply to Section 2 and Section 3, which have slightly smaller lots and sewer hook-ups instead of septic systems.
